RENTAL AGREEMENT FOR GRADUATION CLOTHING

LESSOR:

YGC COMUNICACIÓN, S.L., (CHAQUE MADRID), with CIF B-81347528 and registered office at Calle Ayala, 57, 28001, Madrid – tel. 91 402 18 08, rents to the following:

TESTING AND CONFORMITY:

Rental on our website:
The lessee acknowledges that the garments have been ordered according to the measurements accepted and communicated by the lessee in the order placed on the Chaqué Madrid website, in the Instituto de Empresa Graduations section, confirming and choosing their size. Therefore, they are obligated to pay the rental fee. Subsequent claims for unsuitability of the chosen size are not acceptable.

DELIVERY:

The garment described will be delivered to the lessee at the Instituto de Empresa facilities on the date specified by email.

CANCELLATION OF A RENTAL:

If, after the fitting of the garment has been completed, the lessee cancels the rental for any reason, they must notify us by email at info@chaquemadrid.com.

The amount charged at the time of booking, or any down payment, regardless of the amount, will not be refunded; the amount will be used to cover the costs incurred in preparing the garments.

OBLIGATION OF DILIGENCE AND CARE

As a CHAQUE MADRID customer, you expressly agree to take all necessary measures to maintain the integrity and quality of the garment to be rented, as well as to prevent any damage that may occur.

Under no circumstances may you make any alterations, adjustments, patches, modifications, or modifications to the CHAQUE MADRID garments you rent. Should you do so, CHAQUE MADRID reserves the right to charge you the full replacement value of the corresponding garment.

RETURN OF RENTED GARMENTS:

Chaqué Madrid will have a dedicated team at the graduation venue. Upon departure, after the graduation, you can return the required garments, which are the gown and stole. You may keep the cap and tassel as a souvenir, if you wish.
When returning the rented garments, you must certify that they are in perfect condition, which will be verified by CHAQUE MADRID.

Our rented garments may suffer minor damage that does not entail the loss of the garments. In this case, the renter agrees that CHAQUE MADRID will charge them for the cost of any alterations required to remedy the minor damage.

If the renter paid by credit card, they expressly agree to be charged the value of said alterations to this credit card, up to a limit of €300.

CHAQUE MADRID considers minor damage to include removable stains, loose hems, torn zippers, torn pockets, loss of buttons, and other damage that does not affect the integrity, fit, or use of the garment.

Upon return of the garment, CHAQUE MADRID will provide the renter with a receipt confirming this, which will justify the return of the garment.

PENALTY:

A penalty of 15 euros is agreed upon for each day the garment is late. If the renter paid by credit card, they expressly authorize CHAQUE MADRID to charge the amounts corresponding to the aforementioned penalty, without having to request express authorization to do so.
In the event of non-return, the renter authorizes Chaqué Madrid to charge their credit card for the amounts of the unreturned garments, the prices of which are detailed in the following point.

LOSS, SERIOUS DAMAGE, OR NON-RETURN OF THE GARMENT:

The rented garment is valued as detailed in the following section, which the lessor is obligated to pay CHAQUE MADRID in the event of loss, theft, non-return, or serious damage that renders the garment unusable.

VALUE OF THE GARMENTS:

The rented garments are valued as follows:

GOWN: €125
STOLE: €60

DATA PROTECTION: The data provided by the lessee will be incorporated into a file duly registered with the Spanish Data Protection Agency, owned by YGC COMUNICACIÓN, S.L., for the purpose of maintaining the business relationship and communicating information about the service provided. The tenant may exercise their rights to update, rectify, cancel, and change their mind by sending their request to c/ Resina 35, Nave 7, 28021 (Madrid) or to the following email address: Info@chaquemadrid.com.

The data subject expressly agrees that their personal data may be used by CHAQUE MADRID or any other company in the group, and may become part of the marketing file. By checking the box during the rental process (“Subscribe to our communications, offers & promotions”), you expressly authorize us to send you communications, offers, and promotions by email, postal mail, or by post.

APPLICABLE JURISDICTION AND JURISDICTION:

For any questions, issues, or disputes that may arise regarding the interpretation or execution of this contract, the parties agree, waiving any other jurisdiction that may apply, to expressly submit to Spanish law and the jurisdiction of the Courts and Tribunals of the city of Madrid.
